In today’s competitive zone getting a job is very difficult and a hand raising effort. As due to decrease in employability rateand increase in population rate the educated persons become demoralized for their future. Due to decrease in economy of India many Industries in India are running in Loss which becomes the main reason of cost cutting and firing in companies. When a person loses his/her job he got depressed and faces many problem financially and mentally both. The loss in job is also due to factory winding up, retrenchment, closure or any other reason. To release the burden of unemployment government of India introduced new type of scheme for the welfare of unemployed people. In this scheme government provides certain type of financial help to the unemployed persons on the basis of monthly unemployment allowance under ESI scheme (Employee’s State Insurance). In this scheme only those persons get the benefits that are loss their regular job due to winding up ,Bank corrupt or retrenchment of that company.

This scheme“Rajiv Gandhi Shramik Kalyan Yojna 2020”i.e. 1st April, 2005. In this scheme more amendments are made and the scheme has been reviewed to increase the range of this scheme so that more people get the benefits of this scheme.Under the Scheme, an Insured Person either male/female loss their   regular job  on or after 1st April,2005, shall be entitled to avail the benefits of unemployment allowance,  closure of the Factory/retrenchment or permanent winding up .

Key point of RGSKY

  1. Only those people get the benefit of this scheme who are insured under ESI Act at the time of loss of their job in form of closure or retrenchment of concerned company.
  2. The person’s minimum contribution for a period of 5 years under the ESI scheme at the time of loss of their job.
  3. This unemployment allowance shall be stopped when insured person again get the job.
  4. The unemployment allowance shall not be covers maternity, sickness benefits or temporary disablement benefits at same time.
  5. The amount money given as an unemployment allowance define under section 61 of ESI Act (Employee’s State Insurance) 1948.
  6. This allowance is payable to insured person approximate period of 1 year.
  7. The amount money under unemployment allowance will be 50 % of last 1 year salary/income.
  8. In this scheme applicant person and his dependent family members are take the benefit of medical treatment under ESI Act for continues period of one year from the date of last employment.
  9. The amount of unemployment allowance shall be stopped when the insured person gets the job or attain the retirement age i.e 60 years.
  10. Under this Scheme, the applicant can get a daily rate of allowance and medical treatment for him/her and their dependent family members within the period of unemployment up to 2 years.

Eligibility to get the benefits of Unemployment Allowance

  1. Insured person must be unemployed after the month of April 2005.
  2. Applicant person can avail the benefit of this scheme after minimum the period of one month fromthe date of loss of their job.
  3. Under this scheme only those peoples are covered who are contribute at least 2 years under the ESI Act at the time of loss of their job.
  4. In this scheme applicant must applied or claim the unemployment allowance within 1 years of unemployment.
  5. The Unemployment allowance is provided for a period of 24 months in alifetime as an employee or until he/she attain the age of 60.
  6. Applicant only can get the financial help and medical facility under this scheme.

Disqualification under this scheme:-

  1. Lose their employment due to union strike or employee strike.
  2. Voluntary retirement
  3. Applicant attain the age of 60 years or above.
  4. Applicant loses their regular job due to any dispute or committing any criminal offence.
  5. When person get new job then he/she will be disqualified from this scheme.

Documentary Evidence: –The documentary evidence includes 2 type of details i.e

  1. Company Details
  2. Employees Details

Company Details :-It includes

  • Company’s incorporation certificate.
  • DSC  (Digital signature certificate) or identification proofs of director/directors.
  • Proper maintained and valid list of director/directors with their address proof document.
  • Copy of Memorandum of association (MoA) or Articles of association (AoA)
  • Correct Mobile numbers and Email ID of director/directors.
  • Copy of board resolutions.

Employee Details:-

  • Name of the employee and father,s name
  • Appointment Letter
  • DOB certificate
  • Name of nominee prescribed in employment form at the time of joining.
  • Salary statement
  • Updated Aadhaar Card
  • PAN card
  • Bank account details with passbook
  • Date of Joining

  1. The applicant can claim for Unemployment Allowance in between 3 months from the date of lose their job.
  2.  The applicant can applied to the proper channel or concerned Branch Officei.e ESI corporation office in the Form -(US-1) attached with documentary proof in Form (UA-2) showing their unemployment.
  3. The certificate is given by the concerned inspector of factories prescribed under factories act, commissioner under labour workmen compensation act or any other concerned authority.

Mode of Payment of under this scheme:-

  1. The Unemployment allowance is paid through by Account Payee Cheque.
  2. If the applicant will be died in this period of 2 years than unemployment allowance is continue for completion of 2 years and payable to his/her nominee.
  3. OTHER:- Central Government Schemes.
